1. Introduction
Welcome to NeutralFoyerSpace ("we," "us," or "our"). These Terms & Conditions ("Terms") outline the rules and regulations for the use of our yacht charter services and the website situated at neutralfoyerspace.site, which is managed by NeutralFoyerSpace.
By reserving a yacht or utilizing our Service, you consent to adhere to these Terms. Should you reject any segment of the terms, you are prohibited from accessing the Service.
2. Service Overview
NeutralFoyerSpace offers an array of deluxe yacht charter services including, but not confined to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service provision is dependent on availability and meteorological conditions. We have the authority to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For charter booking, you are required to:
- Be a minimum of 18 years old
- Supply valid and complete details
- Remit the necessary down payment as outlined in your booking acknowledgement
- Concur with these Terms & Conditions
3.2 Confirmation
A charter booking is only deemed confirmed once payment is received along with our written affirmation. We exercise the ability to decline services to any individual at our discretion.
3.3 Availability
Charter availability hinges upon both vessel availability and favorable weather conditions. Reasonable efforts shall be made to satisfy requests for specific dates and times.
4. Payment Terms
4.1 Pricing
All rates are presented in € and incorporate applicable taxes, except where indicated otherwise. Pricing is subject to modification without pre-notification.
4.2 Payment Schedule
- Deposit: A requirement of 50% of the total cost of charter upon booking
- Remaining balance: Payable 48 hours prior to the departure of the charter
- Supplementary fees (where applicable): Payable upon the charter's conclusion
4.3 Payment Methods
Payment can be made through major credit cards, electronic bank transfers, and certified cheques. Payment processing utilizes secure, encrypted technology.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours prior to departure: Complete refund minus administrative fees
- For cancellation from 24 to 72 hours before departure: Refund of 50%
- Less than 24 hours prior to departure: No refund available
5.2 Weather Cancellations
Should the captain deem weather conditions as unsuitable, we propose to:
- Reschedule the charter at no additional cost for the next feasible date
- Issue a complete refund if rescheduling is not an option
5.3 Mechanical Issues
In case of mechanical failures with the designated vessel, we'll strive to offer an adequate alternative. If no alternatives are feasible, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all crew directives
- Utilize provided safety gear as needed
- Disclose any medical conditions that could impact their safety
- Stay within the vessel's designated zones
6.2 Prohibited Items
Certain items are not allowed on the yacht:
- Glass articles
- Unlawful substances
- Firearms or other weapons
- Excessive quantities of non-alcoholic drinks (beyond reasonable consumption)
- Pets (unless prior authorization is granted)
6.3 Conduct
Guests must behave respectfully. A charter can be terminated early, without a refund, if a passenger's conduct endangers safety or detracts from the experience of other guests.
7. Liability and Insurance
7.1 Our Liability
Our accountability is restricted to the charter fees paid. We bear no responsibility for:
- Injuries incurred due to guest negligence
- Theft or damage of personal belongings
- Indirect, secondary, or punitive losses
- Delays resulting from weather or situations beyond our control
7.2 Insurance Coverage
Appropriate marine insurance is maintained, covering both our fleet and operations. It's the passenger's obligation to ensure they have adequate travel and personal insurance.
7.3 Assumption of Risk
By participating in our yacht services, you accept that nautical activities possess inherent hazards, and you assume responsibility for your safety and health.
8. Modifications and Itinerary Changes
We reserve the authority to amend itineraries, courses, or timetables based on meteorological conditions, safety requisites, or operational needs. We shall make every effort to offer similar alternative experiences.
9. Force Majeure
We shall not be held accountable for postponements, cancellations, or alterations caused by forces outside our control, which include, but are not limited to:
- Severe meteorological conditions
- Natural calamities
- Governmental regulations
- Port barricades
- Mechanical breakdowns
10. Privacy and Data Protection
Your personal data is processed following our Privacy Policy. By engaging with our services, you acquiesce to the collection and utilization of your data as outlined in our Privacy Policy.
11. Intellectual Property
All material on our website, which includes text, visuals, logos, and imagery, is protected under copyright and trademark laws. Reproduction, dissemination, or creation of adaptations without our explicit consent is unauthorized.
12. Governing Law
These Terms are under the jurisdiction of the laws of Monaco. Disputes will be settled in the courts in Monte Carlo, Monaco.
